Pizza-Oven Chimney Regulations in Italy – Complete Guide to Laws, Court Rulings and Liabilities

 

Opening a pizzeria or restaurant with a wood-fired, charcoal, pellet or gas oven means facing a fundamental issue: the chimney (canna fumaria).
In Italy a chimney is not just a technical choice – it is a legal obligation.
Failure to install a compliant flue can lead to administrative fines, civil damages, and even criminal prosecution.

 

Mandatory Chimney for Wood-Fired Ovens

 

Italian and EU regulations require every combustion appliance to discharge flue gases to the roof through a dedicated chimney.

Key legal references

Italian Civil Code art. 844 – prohibits smoke emissions beyond “normal tolerability,” even if the business is authorized.

Civil Code arts. 890 & 907 – impose safety distances from balconies, windows and neighboring properties.

Presidential Decree (D.P.R.) 380/2001 art. 6 – chimney installation is “free building work,” but must comply with municipal and condominium rules.
