Legislative Decree No. 102 of July 4, 2014: Energy Efficiency and Sustainable Strategy
The Legislative Decree No. 102 of 2014, issued in implementation of the European Directive 2012/27/EU, represents a fundamental step for improving energy efficiency in Italy, promoting the adoption of strategic measures aimed at reducing energy consumption, cutting greenhouse gas emissions, and encouraging the sustainable use of resources.
The decree sets ambitious national objectives, consistent with the targets set by the European Union for 2020 (20% reduction in energy consumption) and 2030 (at least 32.5% energy savings), and provides regulatory, financial, and technical tools for their implementation.
Main Measures and Obligations Provided by the Decree
1. Energy Audits and Energy Management Systems
- Large enterprises and energy-intensive companies (high energy consumption) are required to conduct energy audits every four years, as established by Article 8 of the decree.
- The audits must be carried out by qualified entities, registered with ENEA lists or accredited bodies.
- The adoption of energy management systems compliant with ISO 50001 is encouraged, which exempts companies from the obligation of periodic audits.
2. Energy Efficiency in Buildings
- Aim to improve the energy efficiency of public and private buildings through:
- The adaptation of the energy performance of public administration buildings, which must renovate at least 3% of the total useful surface area each year.
- Incentives and financing for thermal insulation interventions, replacement of winter heating systems with more efficient solutions, installation of solar panels, and heat pumps.
3. National Fund for Energy Efficiency
- The decree established the National Fund for Energy Efficiency to support interventions for improving energy performance, through:
- Concessional financing for companies and individuals.
- Guarantees for innovative projects.
- Priority sectors include industry, the tertiary sector, and residential construction.
4. Obligations for Energy Distributors
- Energy sector operators are required to achieve annual energy savings for end customers through efficiency measures, such as the installation of advanced technologies and the promotion of energy performance contracts.
5. Promotion of Esco (Energy Service Company)
- The establishment and activity of Esco, companies specializing in the provision of energy efficiency services, are encouraged.
- Esco can manage interventions in EPC mode (Energy Performance Contract), where compensation is linked to the actual energy savings achieved.

- Promotion of the use of innovative technologies, such as photovoltaic systems, condensing boilers, and energy storage systems.
